1. Introduction
These Terms and Conditions ("Terms") govern your use of the Design Orbits website and the purchase of design services from Design Orbits ("we", "us", "our"). By placing an order or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.
2. Our Services
Design Orbits provides the following services:
- Logo design and brand identity design
- Web design and development
- Graphic design (flyers, social media assets, marketing materials)
- Graphic design subscription packages
- Branding strategy and visual identity
The scope of each service is defined in the package description or project brief agreed at the time of purchase.
3. Orders and Payment
3.1 All prices are displayed in GBP (British Pounds) unless otherwise stated. Prices for US clients may be displayed in USD.
3.2 Payment is required in full before design work begins, unless a written payment plan has been agreed.
3.3 We accept payment via the methods listed on our website. All transactions are processed securely by our payment provider.
3.4 Subscription services are billed on a recurring basis (monthly or annually) as selected at checkout. Subscriptions will auto-renew unless cancelled before the renewal date.
4. Design Process and Revisions
4.1 Following payment, we will begin work on your project in accordance with the brief provided.
4.2 We will deliver initial concepts within the timeframe stated in your package. Delivery times are estimates and may vary depending on project complexity and client response times.
4.3 Each package includes a stated number of revision rounds. Revisions beyond the included allowance may be subject to additional charges.
4.4 A revision is defined as a reasonable modification to an existing concept. A complete change of direction or new brief after initial concepts have been delivered may be treated as a new project.
5. Client Responsibilities
5.1 You are responsible for providing accurate, complete, and timely information required for us to deliver your project, including brand guidelines, content, logos, and images.
5.2 You confirm that any materials you provide to us (text, images, trademarks) are owned by you or that you have the legal right to use them. You indemnify Design Orbits against any claims arising from materials you supply.
5.3 Delays caused by late or incomplete client input may extend delivery timelines. We are not liable for delays resulting from failure to provide required information.
6. Intellectual Property
6.1 Upon receipt of full payment, you will own the final approved design files and full intellectual property rights to the delivered work, unless otherwise agreed in writing.
6.2 We retain the right to display completed work in our portfolio, on our website, and in marketing materials unless you request otherwise in writing.
6.3 Preliminary concepts, draft designs, and rejected options remain the intellectual property of Design Orbits.
6.4 We do not transfer rights to working files (e.g. layered PSD, AI, or Figma source files) unless explicitly included in your package or agreed separately.
7. Cancellations and Refunds
7.1 If you cancel your project before initial concepts have been delivered, you are entitled to a full refund minus any administrative fees.
7.2 Once initial concepts have been delivered, no refund will be issued as significant work will have been completed.
7.3 Subscription services may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
7.4 If you are unsatisfied with our work, please contact us at info@designorbits.com. We will make every reasonable effort to resolve the issue within the scope of the agreed brief.
8. Limitation of Liability
8.1 Design Orbits shall not be liable for any indirect, incidental, or consequential loss arising from the use of our services, including loss of revenue, loss of data, or damage to reputation.
8.2 Our total liability in connection with any project shall not exceed the total fees paid by you for that project.
8.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
9. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of a project. We will not disclose your project details, business information, or brief to any third party without your consent, except where required by law or necessary to deliver the service (e.g. sharing a brief with a sub-contractor under NDA).
10. Subscription Terms
10.1 Subscription plans provide access to ongoing design services within the scope defined by the selected plan.
10.2 Unused design requests do not roll over to the following month unless stated otherwise in your plan.
10.3 We reserve the right to modify subscription pricing with 30 days written notice to active subscribers.
10.4 We reserve the right to suspend or terminate a subscription if these Terms are breached.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on our website with a revised date. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
